What Actually Differs Between Carriers
Premiums get the attention, but the following policy features determine what your insurance is worth when you need it:
- **Defense costs inside or outside the limits.** If defense costs erode your limit, a $1,000,000 policy can shrink to a fraction of that before settlement talks begin. Policies that pay defense costs in addition to the limit deliver meaningfully more protection for the same headline number.
- **Consent to settle.** Some carriers require your consent before settling a claim; others reserve the right to settle over your objection. For attorneys, reputation damage from an unwanted settlement is a real risk, so this provision matters.
- **Tail (extended reporting) pricing.** Claims-made policies end when you retire or switch carriers. Tail coverage can cost anywhere from roughly one to three times your annual premium depending on the carrier. If you are within a few years of retirement, this single term can matter more than the premium.
- **Retroactive date flexibility.** Carriers differ in how far back they will extend prior acts coverage, and whether they will match a retroactive date from a prior policy. This is exactly where firms without prior insurance need a broker who negotiates.
- **Claims handling.** Who defends you matters. Carriers with dedicated legal malpractice claims units and panels of experienced defense counsel resolve claims faster and with less friction.
- **Underwriting appetite.** Carriers price practice areas differently. Plaintiff-side litigation, securities, and IP work see the widest spread between the cheapest and most expensive market.
The Markets We Work With
We compare your firm's profile against multiple A-rated carriers. Here is how we think about each:
**Arch Insurance** — A national market with a strong lawyers professional liability product and appetite for a wide range of firm sizes. Arch tends to be competitive for firms that present clean risk profiles and offers broad coverage terms with modern endorsements.
**Zurich** — A global carrier with substantial resources and strong risk management support. Zurich is often competitive for larger firms and firms that want the balance sheet of a major international insurer behind their policy.
**The Hanover** — Known for service-oriented underwriting and competitive pricing for small firms and solo practitioners. The Hanover is frequently one of the more affordable options for new and growing practices without sacrificing core coverage terms.
**Attorney Protective** — A specialist lawyers program that focuses exclusively on attorney professional liability. Specialist programs often bring deeper understanding of legal malpractice claims and flexible underwriting for firms that do not fit standard molds, such as firms without prior coverage or with unusual practice mixes.
The right answer depends on your firm. A solo attorney in a low-risk practice area, a five-lawyer litigation boutique, and a retiring partner each have a different "best" carrier, and the cheapest quote for one can be the worst fit for another.
How to Compare Quotes Properly
When you receive multiple quotes, line them up against this checklist before comparing prices:
1. Same limits and deductible? A cheaper quote with a $1,000,000/ $1,000,000 limit and higher deductible is not the same product as a $1,000,000/ $2,000,000 aggregate quote. 2. Defense costs outside the limits? 3. Consent-to-settle included? 4. Retroactive date matches your prior coverage (or the earliest date you need)? 5. What does tail coverage cost if you leave practice next year? 6. A-rated carrier (A.M. Best rating of A or better)? 7. Does the application accurately reflect your practice areas? Misstated practice areas can void coverage.
Why Comparing Carriers Requires a Broker
Many of the best lawyers professional liability markets are only available through appointed brokers, and pricing between carriers for the same firm routinely differs by 20% to 40%. An independent specialist broker shops the market for you, translates the coverage differences into plain terms, and negotiates terms like retroactive dates that carriers rarely volunteer.
